1. Acceptance of Terms

By accessing or using TextHer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use TextHer. By using the Service, you represent and warrant that you meet this age requirement.

3. Service Description

TextHer is an AI-powered conversation practice application that simulates realistic text messaging interactions. The Service uses artificial intelligence to generate responses, feedback, and simulate dating conversation scenarios for educational and practice purposes.

Important: All conversations are simulated. You are interacting with AI-generated personas, not real people.

4. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must not share your account with others
• You must notify us immediately of any unauthorized access to your account

5. Subscription Plans

Free Tier

• 5 messages per day
• 1 new conversation per day
• 1 scenario available
• Basic flag feedback (visual indicators only)

Premium Subscription

• Weekly: $7.99/week
• Annual: $89/year
• Unlimited messages
• All conversation scenarios
• Detailed AI feedback explanations
• Priority scheduling

Billing Terms

• Subscriptions auto-renew unless cancelled before the renewal date
• Charges are non-refundable except as required by law
• You can cancel anytime through your app store account settings
• Price changes will be communicated 30 days in advance
• Billing is managed through the Apple App Store or Google Play Store

6. Acceptable Use Policy

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to manipulate, exploit, or abuse the AI system
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to harass, threaten, or harm others
• Share explicit, illegal, or harmful content
• Create multiple accounts to circumvent usage limits
• Use automated tools or bots to interact with the Service
• Impersonate others or misrepresent your identity

7. AI-Generated Content

Nature of AI Content

• All responses, feedback, and interactions are generated by artificial intelligence
• AI responses may contain errors, inaccuracies, or inappropriate content
• The AI system autonomously determines response timing, tone, and behavior (including simulated "ghosting" or "blocking")
• We do not guarantee the accuracy, appropriateness, or quality of AI-generated content

Educational Purpose Only

• TextHer is designed for conversation practice and skill development
• The Service does NOT provide professional dating advice, relationship counseling, or therapeutic services
• AI feedback is for educational purposes and should not be taken as absolute truth
• We make NO guarantees about real-world dating outcomes based on app usage

No Replacement for Professional Advice

• The Service is not a substitute for professional psychological, therapeutic, or relationship counseling
• If you need professional support, consult a licensed professional

8. Intellectual Property

Service Ownership

• TextHer, including all code, designs, algorithms, and AI models, is owned by us and protected by intellectual property laws
• You receive a limited, non-exclusive, non-transferable license to use the Service for personal purposes

Your Content

• You retain ownership of messages you send through the Service
• By using the Service, you grant us a worldwide, royalty-free license to use, store, and process your messages to:
  • Provide and improve the Service
  • Train and improve AI models
  • Analyze usage patterns and performance
• We will not share your personal messages publicly or with third parties for marketing purposes

9. Termination

By You

• You may delete your account at any time
• Deleting your account does not automatically cancel paid subscriptions (manage through app store)

By Us

• We reserve the right to suspend or terminate accounts that violate these Terms
• We may terminate or modify the Service at any time with or without notice
• Upon termination, your right to use the Service immediately ceases

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted, timely, secure, or error-free service
• Accuracy or reliability of AI-generated content
• Any specific outcomes or results from using the Service

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
• This includes damages for emotional distress, lost profits, data loss, or business interruption
• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

We specifically disclaim liability for:

• Real-world dating outcomes or relationship results
• Emotional reactions to AI-generated content or simulated behavior
• Any actions you take based on AI feedback or suggestions
• Service interruptions or data loss

12. Privacy

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• We collect account information, messages, and usage data
• We use data to provide and improve the Service
• We do not sell your personal information
• Push notifications may contain message content

13. Push Notifications

• The Service sends push notifications containing message content from AI personas
• You can disable notifications through your device settings
• Notification delivery is not guaranteed due to device and network limitations

14. Changes to Terms

• We may modify these Terms at any time
• Material changes will be notified via email or in-app notification
• Continued use after changes constitutes acceptance of new Terms
• If you disagree with changes, you must stop using the Service and delete your account

15. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

Dispute Resolution

• Any disputes shall first be attempted to resolve through good-faith negotiation
• If negotiation fails, disputes shall be resolved through binding arbitration
• You waive the right to participate in class-action lawsuits
• Some jurisdictions do not allow arbitration agreements, so this may not apply to you

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TextHer regarding the Service.
